TERMS AND CONDITIONS OF USE

Welcome to BolJao ("App", "Service", "Platform"). By accessing or using BolJao, you agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using BolJao.
1. ACCEPTANCE OF TERMS
1.1 By registering an account, accessing, or using BolJao, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
1.2 If you do not agree to these Terms, you must not use BolJao and should immediately discontinue access.
1.3 You must be at least 18 years of age to register and use BolJao. By registering, you represent and warrant that you are at least 18 years old.
2. USER REGISTRATION AND ACCOUNT
2.1 To use certain features of BolJao, you must register for an account by providing accurate, current, and complete information, including but not limited to:
- Full name
- Valid mobile number
- Password
- Aadhar number (optional)
- Driving license (for drivers)
- Profile picture (optional)
2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 You agree to:
- Provide accurate and truthful information
- Update your information promptly if it changes
- Not share your account credentials with any third party
- Notify BolJao immediately of any unauthorized use of your account
2.4 BolJao reserves the right to suspend or terminate accounts that provide false information or violate these Terms.
2.5 Account verification is done through OTP (One-Time Password) sent to your registered mobile number. You agree to receive OTP messages for verification purposes.
3. RIDE OFFERING (DRIVER TERMS)
3.1 Drivers may offer rides through BolJao by providing:
- Start and end locations
- Via locations (if applicable)
- Journey date and time
- Number of available seats
- Price per seat or for complete car
- Vehicle details (must be registered in your profile)
3.2 Vehicle Registration Requirements:
- You must register at least one vehicle in your profile before offering rides
- Vehicle information must include: brand, model, registration number
- You must upload clear photos of your vehicle
- You must upload valid registration certificate (RC) documents
- All vehicle information must be accurate and current
3.3 Driver License Requirements:
- You must have a valid driving license
- You must upload your driving license in your profile
- Your license must be valid and not expired
- You are responsible for ensuring your license remains valid
3.4 Driver Responsibilities:
- You are responsible for the safety and conduct of passengers during the ride
- You must ensure your vehicle is in good working condition, properly insured, and legally registered
- You must comply with all traffic laws and regulations
- You must arrive at the pickup location at the agreed time
- You must complete the journey as specified in your ride offer
- You are responsible for any damages or incidents that occur during the ride
3.5 Pricing:
- You set the price for your ride offer
- Prices are displayed per seat or for complete car booking
- You agree to honor the price quoted at the time of booking
- Payment is collected directly from passengers (Cash/UPI) upon trip completion
3.6 Ride Cancellation by Driver:
- You may cancel a ride offer before passengers book seats
- If you cancel after passengers have booked, you may be subject to penalties
- You must provide reasonable notice for cancellations
- Repeated cancellations may result in account suspension
4. RIDE REQUESTING (PASSENGER TERMS)
4.1 Passengers may request rides through BolJao by providing:
- Start and end locations
- Journey date and time
- Number of seats required
- Maximum price willing to pay (per seat or for complete car)
- Landmark or additional location details
4.2 Booking Options:
- You may book individual seats or the complete car
- Booking is confirmed when a driver accepts your request or you accept a driver's offer
- You may receive multiple offers from different drivers for your request
4.3 Passenger Responsibilities:
- You must be present at the pickup location at the agreed time
- You must provide accurate pickup and drop-off locations
- You must respect the driver and other passengers
- You must pay the agreed amount upon trip completion
- You are responsible for your personal belongings
4.4 Booking Cancellation by Passenger:
- You may cancel a booking before the trip starts
- Cancellation terms and any compensation are matters to be resolved directly between driver and passenger
- BolJao does not process refunds or handle cancellation compensation
- Repeated cancellations may result in account restrictions
5. BOOKING AND PAYMENT
5.1 Booking Confirmation:
- Bookings are confirmed when both parties agree to the terms
- You will receive a booking confirmation with trip details
- An OTP may be generated for ride verification
5.2 Payment Terms:
- Payment is made directly between driver and passenger upon trip completion
- Payment methods include Cash and UPI
- BolJao does not process, handle, or facilitate any payments
- BolJao only connects drivers and passengers; all payment transactions are between users
- You are solely responsible for ensuring payment is made as agreed between parties
5.3 Payment Status:
- Payment status may be tracked within BolJao for informational purposes only
- Statuses include: Unpaid, Paid, Payment Incomplete, Payment Error
- These statuses are for reference only and do not indicate any payment processing by BolJao
- You are responsible for updating payment status accurately
5.4 Price Disputes:
- Prices are agreed upon at the time of booking between driver and passenger
- Any disputes regarding pricing must be resolved directly between driver and passenger
- BolJao is not involved in payment transactions and is not responsible for payment disputes between users
6. CANCELLATION POLICY
6.1 Cancellation by Driver:
- Drivers may cancel ride offers before or after booking confirmation
- If a driver cancels after booking confirmation, they should notify passengers promptly
- Cancellation terms and any compensation are matters to be resolved directly between driver and passenger
- BolJao does not process refunds or handle cancellation compensation
- Repeated cancellations may result in account restrictions
6.2 Cancellation by Passenger:
- Passengers may cancel bookings before the trip starts
- Cancellation terms and any compensation are matters to be resolved directly between driver and passenger

6.3 Refund Policy:
- BolJao does not process payments and therefore does not handle refunds
- Any refunds or compensation for cancellations must be arranged directly between driver and passenger
- Refund statuses shown in BolJao (if any) are for informational purposes only and do not indicate any refund processing by BolJao
6.4 Trip Completion:
- Trips are marked as completed when both parties confirm completion
- An OTP may be required to verify trip completion
- Once completed, payment should be made directly between driver and passenger as agreed
7. SAFETY AND EMERGENCY FEATURES
7.1 SOS/Emergency Feature:
- BolJao provides an SOS feature for emergency situations
- When activated, your location is shared with your emergency contacts
- Location sharing occurs every 10 seconds while SOS is active
- You must set up emergency contacts in your profile to use this feature
7.2 Emergency Contacts:
- You can add trusted contacts in your profile
- These contacts will receive your location during emergencies
- You are responsible for keeping emergency contact information current
- You consent to location sharing with emergency contacts when SOS is activated
7.3 Location Services:
- BolJao requires location permissions for certain features
- Location data is used for:
* Finding nearby rides
* Sharing location during emergencies
* Trip tracking (if applicable)
- Location data is stored securely and used only as described in BolJao's Privacy Policy
7.4 Safety Guidelines:
- Users are expected to follow all safety guidelines
- Report any safety concerns immediately
- Do not share personal information with other users unnecessarily
- Trust your instincts and do not proceed if you feel unsafe
8. DATA PRIVACY AND THIRD-PARTY SERVICES
8.1 Data Collection:
- BolJao collects personal information necessary to provide our services
- This includes: name, mobile number, location data, vehicle information, trip history
- BolJao does not share your personal data with third parties except as described below
8.2 Third-Party Services:
- OTP Service: BolJao uses a third-party service provider to send OTP messages to your mobile number for account verification and ride-related communications. This is the only third-party service BolJao uses that requires sharing your mobile number.
- The OTP service provider is bound by confidentiality agreements and uses your mobile number solely for delivering OTP messages
- BolJao does not share your personal data with any other third parties for marketing, advertising, or any other purposes
8.3 Data Security:
- BolJao implements reasonable security measures to protect your data
- However, no method of transmission over the internet is 100% secure
- You use BolJao at your own risk regarding data security
8.4 Data Retention:
- BolJao retains your data as long as your account is active
- You may request deletion of your account and associated data
- Some data may be retained for legal or regulatory purposes
9. USER CONDUCT AND PROHIBITED ACTIVITIES
9.1 You agree NOT to:
- Use BolJao for any illegal purposes
- Provide false or misleading information
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Interfere with or disrupt BolJao
- Attempt to gain unauthorized access to BolJao
- Use automated systems to access BolJao
- Share your account with others
- Solicit passengers or drivers outside BolJao for the same trip
- Charge prices different from those agreed upon in BolJao
9.2 Violation of these rules may result in:
- Warning
- Temporary suspension
- Permanent ban
- Legal action if applicable
10. LIABILITY AND DISCLAIMERS
10.1 Service Disclaimer:
- BolJao is a platform that connects drivers and passengers
- BolJao does not provide transportation services
- BolJao is not a party to the agreement between drivers and passengers
- BolJao does not guarantee the availability of rides or passengers
- BolJao does not process payments or handle refunds
10.2 User Responsibility:
- Users are solely responsible for their interactions with other users
- BolJao is not responsible for the conduct of any user
- Users are responsible for verifying the identity and credentials of other users
10.3 Transportation Liability:
- Drivers are solely responsible for their vehicles and transportation services
- BolJao is not liable for any accidents, injuries, or damages that occur during rides
- Drivers must have valid insurance coverage
- Passengers travel at their own risk
10.4 Limitation of Liability:
- To the maximum extent permitted by law, BolJao disclaims all warranties
- BolJao is not liable for any indirect, incidental, or consequential damages
- BolJao's total liability is limited to the amount you paid BolJao, if any (Note: BolJao does not process payments, so this liability is effectively zero)
10.5 Indemnification:
- You agree to indemnify and hold BolJao harmless from any claims arising from your use of the platform
- This includes claims related to your conduct, your vehicle, or your transportation services
11. INTELLECTUAL PROPERTY
11.1 BolJao and its content are protected by intellectual property laws
11.2 You may not copy, modify, or distribute BolJao without permission
11.3 User-generated content remains your property, but you grant BolJao a license to use it within the platform
12. MODIFICATIONS TO TERMS
12.1 BolJao reserves the right to modify these Terms at any time
12.2 Material changes will be notified through BolJao
12.3 Continued use of BolJao after changes constitutes acceptance
12.4 If you do not agree to modified Terms, you must stop using BolJao
13. TERMINATION
13.1 BolJao may terminate or suspend your account at any time for violations of these Terms
13.2 You may terminate your account at any time
13.3 Upon termination, your right to use BolJao ceases immediately
13.4 Provisions that should survive termination will continue to apply
14. DISPUTE RESOLUTION
14.1 Disputes between users should be resolved directly between the parties
14.2 BolJao may facilitate communication but is not obligated to resolve disputes
14.3 For disputes with BolJao, you agree to first contact BolJao through the platform's support features to seek resolution
14.4 These Terms are governed by the laws of India

16. MISCELLANEOUS
16.1 These Terms constitute the entire agreement between you and BolJao
16.2 If any provision is found invalid, the remaining provisions will continue in effect
16.3 BolJao's failure to enforce any right does not waive that right
16.4 You may not assign these Terms without BolJao's consent
By using BolJao, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use BolJao.
